我的業主要求我預先繳付12個月租金,這個情況常見嗎?

我的業主可以加租嗎?

我的業主想修改租約條款,這是否合法?
Your landlord needs your express permission to add in new terms and conditions or amend existing ones. For example, if you own a pet and this is allowed under the terms of your tenancy, you do not have to accept any changes to the terms of tenancy that affect your ability to keep a pet in your property. You should always consider carefully whether to accept any changes to the terms and conditions of your tenancy.
我的申請已經遞交超過12星期,為什麼我還未獲批簽證?我可以如何加快簽證獲批速度?

Is it legal for my landlord to ask for 12 months rent up front?
Oftentimes, landlords ask for rent up front to minimise their risk – for example, if the prospective tenant does not have a UK credit history or a job.
In Scotland a landlord cannot ask you for more than six months rent in advance. Note that this is different from England. A landlord asking for more than six months rent in advance could be committing a criminal offence and can be reported to the police.

Can my landlord increase my rent?
Rents can only be increased if your landlord follows proper procedures. A landlord can increase the rent no more than once a year – tenants must be notified of this decision in writing at least three months before any rent increase is scheduled to take place. This is called a Rent Increase Notice.
If you think the proposed increase is too high or unreasonable, you can apply to Rent Service Scotland to get a Rent Officer to review your case and decide whether the proposed increase is reasonable. This involves a form and providing some information about the proposed increase. You should fill this form out as soon as possible, as you cannot use the service if it has been more than 21 days since you received your Rent Increase Notice. My landlord wants to change the terms of my tenancy. Is this legal?

I applied for my BN(O) visa more than 12 weeks ago – what is the reason for the delay and is there anything I can do to speed up the process?
We are aware that in some cases, it is taking longer than 12 weeks for Hongkongers to hear back about their BN(O) visa application. Below are a few options for chasing up the status of your visa application:
- Use the UKVI contact centre
Telephone: 0300 790 6268 – select option 2, then option 1 Monday to Thursday, 9am to 4:45pm Friday, 9am to 4:30pm. You can find more information on this here: https://www.gov.uk/contact-ukvi-inside-outside-uk/y/inside-the-uk/something-else
- You can make a formal complaint to the UK Visas and Immigration about the length of time it takes for your application to be processed. This is an online form via this link: Complaints procedure – UK Visas and Immigration – GOV.UK (www.gov.uk). Explain that your application has exceeded service standards, that you were not explained why it will not be decided within the normal timescale, and that the delay causes a lot of stress and anxiety for you and your family. The complaint will not affect whether your application is accepted.
- You can contact your local Member of Parliament (MP) via this link Find your MP – MPs and Lords – UK Parliament and ask them to contact the Home Office on your behalf to explain the delay. When writing to your MP, you should include your address in the email, as MPs can only support individuals living in their constituencies. My family entered the UK under a visitor visa – is my child eligible for state education?
A visitor visa does not permit children to receive a state school education. Once you receive your BN(O) visa, you will be able to enrol your child in a state school.
I have moved to Scotland but I am still working remotely for a company/organisation in Hong Kong. What do I need to consider?
You can continue to work for your Hong Kong employer after you move to the UK. However, you will need to pay UK income tax on your foreign income once you become a resident in the UK. This normally means you will need to fill out a Self Assessment tax return. More information can be found here. We advise that you seek professional advice from a taxation expert.
How do I undergo a right to work check?
This is something that your employer does on your behalf, either by checking physical documents or checking your immigration status online. You can either show your Biometric Residence Permit (BRP) card or you can generate an online share code to prove your right to work.
Can a BN(O) Visa Holder work legally in the UK without a National Insurance Number (NINO)? BN(O)
BN(O) status holders can look for and start work without a National Insurance number, as long as you can prove that you have the right to work in the UK. You can do this by authorising a potential employer to access your data by conducting a right to work check. Please note that a National Insurance number does not prove that you have the right to work and is not a part of the right to work check. A right to work check is something that your employer does on your behalf, either by checking physical documents or checking your immigration status online.
Where do I sign up for ESOL classes?
If you contact your Local Authority, they will arrange an assessment to test your English level. You will then usually be put onto a waiting list for ESOL classes.
